This Cookie Notice and Privacy Choices page applies to www.waves.com, its subdomains, Waves mobile applications, and related online services (collectively, the “Services”).

This page explains how Waves Audio Ltd. (“Waves,” “we,” “us,” or “our”) uses cookies and similar technologies and describes the privacy controls available to you. For users in the European Economic Area (“EEA”) and United Kingdom, this page also describes the legal bases we rely on for the use of such technologies, as required under applicable law.

This page describes the technologies used on our Services for functionality, analytics, advertising, and advertising measurement purposes and provides you with controls over how these technologies are used. We do not sell personal information for monetary consideration.

This link directs you to Section 4 of this page, where you can manage your preferences and exercise your rights through the interactive controls provided.

Under applicable ePrivacy laws, we are required to obtain your consent before storing or accessing non-essential cookies and similar technologies on your device.

Accordingly:

  • Strictly necessary cookies are used based on our legitimate interests (Article 6(1)(f) GDPR) to operate, secure, and provide the Services
  • All other cookies (including performance, analytics, functional, and advertising cookies) are only used with your consent (Article 6(1)(a) GDPR), as required under applicable law

To the extent that information collected through these technologies constitutes personal data, such data is processed in accordance with the GDPR lawful bases described above.

Where we rely on consent, you have the right to withdraw your consent at any time, without affecting the lawfulness of processing prior to withdrawal.

3. Information Collected Through These Technologies

Depending on your settings, these technologies may collect:

  • IP address
  • Device and browser identifiers
  • Operating system
  • Approximate location (city/state/country level)
  • Pages visited and interactions
  • Advertising identifiers
  • Hashed identifiers used for advertising matching (where applicable)

Where reasonably possible, analytics information is used in aggregated or de-identified form. Where such information constitutes personal data under applicable law, it is processed in accordance with the legal bases described above.

We do not intentionally collect through cookies:

  • Precise geolocation
  • Health information
  • Biometric data
  • Racial or ethnic data
  • Other sensitive personal information

4. Your Privacy Choices and Controls

This section provides interactive controls that allow you to exercise your privacy rights and manage the use of cookies and similar technologies on the Services, including opting out of the sale of personal information, sharing for cross-context behavioral advertising, and targeted advertising under applicable U.S. state privacy laws.

The “Your Privacy Choices” link in the website footer directs you to this section. The controls below allow you to make and update your selections in real time. These technologies may include cookies, pixels, local storage, software development kits (SDKs), and device identifiers.

You can enable or disable non-essential technologies below. Your selections will apply to this browser or device and can be updated at any time.

Your selections apply to the browser or device you are using.

You may exercise your advertising-related privacy rights at any time by clicking the “Your Privacy Choices” link available in the Website footer. Where applicable, this link is accompanied by the California opt-out icon as defined in 11 CCR § 7015.

The controls described in this section allow you to actively enable or disable categories of technologies based on your preferences and to exercise opt-out rights relating to the sale of personal information, sharing for cross-context behavioral advertising and targeted advertising under applicable U.S. state privacy laws.

The “Your Privacy Choices” mechanism is intended to provide a unified control addressing rights relating to:

  • Sale
  • Sharing for cross-context behavioral advertising
  • Targeted advertising

You may change your selections at any time with the same ease as your initial choice. Where we rely on consent, you may withdraw your consent at any time through these controls. For users in jurisdictions that require prior consent (such as the EEA and United Kingdom), non-essential technologies are disabled by default and are only activated after you provide consent through these controls.

We design our privacy controls to support clear and informed user choices regarding the use of cookies and similar technologies.

No login is required to exercise these controls.

You may designate an authorized agent to submit an opt-out request on your behalf where permitted by applicable law. We may take reasonable steps to verify the agent’s authority.

We will not discriminate against you for exercising your privacy rights, except as permitted by applicable law.

Your selections are applied consistently and may be changed at any time with the same ease as your initial choice.

The controls are presented in a neutral manner and are intended to allow you to enable or disable categories of technologies based on your preferences.

The options presented in the cookie banner (for users in applicable jurisdictions) correspond to the categories of technologies described below.

For purposes of these controls, “Non-Essential Technologies” refers to all technologies other than Essential Technologies (including Performance, Functional, and Marketing Technologies described below). Selecting “Reject Non-Essential Technologies” will disable these categories, except where required for functionality or permitted by applicable law.

Types of Technologies and Their Purposes:

  • Essential Technologies (Strictly Necessary):: These technologies are necessary for the operation of the Services and cannot be disabled through these controls. They are typically set in response to actions you take, such as setting privacy preferences, logging in, or completing transactions. Including: BridgerPay, PayPal, Stripe, Braintree, UserCheck, , SalesForce, UserWay
  • Performance and Functional Technologies: Used to measure and improve service performance and enhance functionality. These technologies help us understand how users interact with the Services and enable features such as personalization. Including: Google Analytics, Web Beacons, Clear GIFs, MessageGears, Discourse, Norton Shopping Guarantee, Intercom, YouTube, Vimeo
  • Advertising Technologies: Used by advertising partners to build a profile of your interests and display relevant advertisements across services and devices. These technologies may uniquely identify your browser or device. Including: Google Ads, DoubleClick, Tracking Pixels, Local Shared Objects (LSOs), Yotpo, Impact Radius, Facebook, TikTok, Bing, Feed Optimise, Outbrain, RTB House

5. Universal Privacy Signals

Some browsers allow users to send automatic privacy preference signals, such as Global Privacy Control (GPC). Where required by applicable law, we recognize such signals and treat them as a request to opt-out of the sale of personal information, sharing for cross-context behavioral advertising, targeted advertising, and the use of non-essential technologies for the browser or device from which the signal is sent.

We generally treat these signals as reflecting your current preference for the browser or device from which they are received. Where such a signal is detected, the relevant settings in the controls described in Section 4 will be automatically adjusted to reflect your preference, to the extent feasible. We evaluate such signals on each visit based on the information received from your browser or device, and our handling of your preferences may change if those signals change.

If we cannot associate the signal with you (for example, if you are not logged in), we will apply it to the browser or device on which it is received, to the extent feasible.

If you use multiple browsers or devices, you may need to configure your preferences on each one.

Global Privacy Control signals are not used as a substitute for consent in jurisdictions that require prior opt-in consent for non-essential technologies.

6. Third-Party Technologies

Some technologies are provided by third parties that support:

  • Analytics
  • Advertising
  • Security and infrastructure

These third parties may act as independent controllers for their own purposes, including advertising and analytics, and may process personal information in accordance with their own privacy policies. Where applicable, they may receive personal information in a manner that could constitute a sale, sharing, or targeted advertising under applicable U.S. state privacy laws. Where required by applicable law, we obtain your consent before allowing third-party technologies that are not strictly necessary to be placed on your device. 7. How We Remember Your Choices

When you select a privacy preference, we store a preference indicator associated with your browser, device, or account (if logged in).

Opt-out preferences remain in effect unless and until you affirmatively change them, subject to applicable legal requirements. Where preferences are based on consent, they remain in effect until withdrawn by you.

For authenticated users, preferences are associated with your account and persist until changed.

For non-authenticated users, preferences are associated with the browser or device identifier available to us.

If you clear cookies, reset your browser, use a different browser or device, or otherwise remove the identifiers associated with your preferences, we may not be able to recognize your prior selections, and you may need to set your preferences again.

We do not prompt reauthorization of sale, sharing, or targeted advertising within twelve (12) months of an opt-out, except where a new preference signal is received (such as a browser-based opt-out signal) or as otherwise permitted by applicable law. We evaluate privacy preference signals on each visit based on the information received from your browser or device. Preference indicators:

  • Are used solely to apply your selections
  • Are treated as strictly necessary
  • Are not used for advertising or tracking

8. Sensitive Data

We do not sell sensitive personal data. We do not use or disclose sensitive personal information for purposes that would require a “Limit the Use of My Sensitive Personal Information” right under applicable U.S. state privacy laws.

Where applicable law requires explicit consent before processing sensitive personal data for advertising or similar purposes, such consent will be obtained before processing.

9. Retention

Cookies may be session-based or persistent.

Information collected through cookies and similar technologies (including for purposes that may constitute sale, sharing, or targeted advertising) is retained only as long as reasonably necessary for the purposes described above.

Opt-out preference indicators are retained for as long as necessary to honor your selection and are not used for advertising purposes. Where possible, retention periods vary depending on the type of technology and its purpose.

10. Updates

We may update this page from time to time. Material changes will be reflected by updating the “Last Updated” date above and the label “updated” will be displayed next to the link "Cookie Notice” in the footer to the website. The “updated” label will be removed after thirty (30) days or when you visit the updated Terms to read them, whichever comes sooner.
